China to Revise Rules on ODS and HFCs

On May 19, 2020 the Ministry of Ecology and Environment (MEE) issued a notice to collect public opinions regarding Management Regulations on Ozone Depleting Substances (ODS) and Hydrofluorocarbons (HFCs) (Exposure Draft), which mainly includes changes in six aspects (e.g. expanding regulation scope to HFCs) compared with current Ozone Depleting Substances Management Regulations – beginning June 1, 2010 and becoming a solid legal foundation for China to eliminate/supervise ODS and carry out Montreal Protocol on Substances that Deplete the Ozone Layer.

Since entering the Montreal Protocol in 1991, China has stopped producing and using five kinds of ODS (CFCs, halon, CTC, TCA and MBr) with limited specific use, exceeded first-stage HCFCs elimination target, realized goals set by the Montreal Protocol. China has so far eliminated around 280 000 tons of ODS, accounting for more than half of quantity that developing countries have eliminated.
